Why of AI LLC is an Artificial Intelligence (“AI”), analytics, and data services, consulting, education and training company.  We help organizations with the use of their data so they can be more data literate, data-driven and data-informed.  We are a company headquartered in Chicago, Illinois, USA.

ABOUT THIS PRIVACY NOTICE

Why of AI LLC d/b/a Why of AI and Expericom and InnoArchiTech (the “Company”, “Why of AI”) is committed to protecting the privacy of our users.  Our Privacy Notice (“Notice”) is designed to help you understand how we collect, use and safeguard the Personal Information (“Information”) you provide to us.  This will allow you to make informed decisions when using our Site and Services.

For purposes of this Agreement, “Sites” refers to our websites, which can be accessed at www.whyofai.com or the website accessed at learn.whyofai.com, which is also owned and maintained by the Company.

“Service” refers to the services accessed via the Sites, in which users can learn about us and our offerings.  Users can also view and download information and media, contact us, join our email mailing list, and schedule paid and non-paid services such as phone calls, video conferences, education and training, advisement, and consultations.

The terms “we,” “us,” and “our” refer to our Company.

“You” refers to you, as a user of our Sites or our Service.

CHANGES TO OUR PRIVACY NOTICE

We may change our Notice due to changes in our business practices or changes in the privacy laws we are subject to.  We encourage you to check this Notice regularly as we will list the most recent revision at the top of this Notice where it states “Last Updated.”

PRIVACY LAWS

Please note there are many privacy laws and regulations around the world and that this Notice simply cannot cover all these laws and regulations.  Some laws may provide stricter protections than others.  As an example, the European Union General Data Protection Regulation (“EU GDPR”) is the privacy law that governs in the European Union.  The EU GDPR is generally stricter than existing US privacy laws. 

Regardless, we will treat your Information in accordance with this Notice to ensure that your privacy is respected and protected.

By accessing our Sites or our Service, you accept our Privacy Notice and Terms of Use (found here: www.whyofai.com/terms), and you consent to the collection, storage, use and disclosure of your Information as described in this Notice.

INFORMATION WE COLLECT

This section tells you about what Information we collect from you and use.  You should read this section carefully as it contains important information.  The two types of Information we collect are:

1.     Information you knowingly provide to us on an individual basis, and

2.     Information that cannot be used to identify you that is collected on an aggregated basis when you browse and use our Services

The rest of this section details these two types of Information.

Information you knowingly provide to us on an individual basis

To browse our Services, you do not need to submit any Information.  There may be limited times where you knowingly provide us Information.  This can include:

·       Business telephone number,

·       Business e-mail,

·       Business address,

·       Business website address,

·       Industry/organization,

·       Job title,

·       Number of employees,

·       Purchasing time frame,

·       Role in purchasing process,

·       Any personal contact information if you choose to provide it (includes personal e-mail, phone number),

·       Any information needed to connect with us through our social media presence,

·       Preferences and behavior (such as record of comments, responses and questions asked),

·       Performance related information,

·       Any other business information we need to provide Services.

 

Information that cannot be used to identify you

To use our Services, you do not need to submit Information that can be used to identify you.  We do, however, collect Information that cannot be used to directly identify you.  This type of Information can be called non-personal Information (“Aggregated Information”).  Although Aggregated Information cannot identify you, we still feel it is important to share our practices with you.

Aggregated Information is collected automatically by technology to improve the quality of the Service.  Examples include:

·       We track Aggregated Information provided to us by your browser or by our software application when you view or use the Service, such as the website you came from (known as the “referring URL”),

·       Type of browser you use,

·       Type of device from which you connected to the Service,

·       Time and date of access,

·       Other Aggregated Information that does not personally identify you.

We may also receive non-personal information, such as aggregated or de-identified demographic/profile information, from third-party sources such as companies that specialize in providing enterprise information, analytics, and software as a service. We may also use clear gifs, pixel tags and web beacons, which are tiny graphic images placed on website pages and/or emails that allow us to determine whether you’ve performed specific actions and are further used to track online movements of our users.

We also track Aggregated Information using cookies, or small text files which include an anonymous unique identifier. Cookies are sent to a user’s browser from our servers and are stored on the user’s computer hard drive. Sending a cookie to a user’s browser enables us to collect general data about that user and keep a record of the user’s preferences when utilizing our services, both on an individual and aggregate basis.

We may use both persistent and session cookies.  Persistent cookies remain on your computer after you close your session and until you delete them.  Session cookies expire when you close your browser.

Choices for Cookies

You have a choice over use of Cookies.  You may remove or block cookies using the settings in the browser.  However, this may negatively impact your ability to use the Services and/or impact the user experience while using the Services.  Users should refer to their specific web browser’s instructions on how to do this.  

By accessing or using the Services, you consent to the placement of cookies on your devices as described in this Notice. 

HOW WE USE AND SHARE INFORMATION

We use information collected as described in this Notice to provide you with the Services and/or information and/or content that you have requested, and, in some cases, to contact you about our classes, products and/or other services.  We also use the information collected to take the following actions: 

 

·       Provide you a newsletter regarding products and services you have used or purchased in the past;

·       Schedule appointments or otherwise register for the Services;

·       Operate, maintain and improve the Services;

·       Sharing data with authorized persons (such as employers) in connection with your use of the Services;

·       Inform you of progress and data related to the use of the Services;

·       Answer questions and respond to your requests;

·       Perform analytics and conduct research;

·       Send you reminders, support and marketing messages;

·       Manage our administration of the Services;

·       Analyze programs, products and services we offer;

·       Inform you about products, events and/or other promotional purposes; and

·       Use information for other purposes about which we notify you.

 

In general, we use Aggregated Information to help us improve the Service and customize the user experience. We also pool and combine this Aggregated Information to track trends and analyze use patterns on the Sites.  Because Aggregated Information cannot be used to directly identify you, this type of Information is not covered by privacy laws.  This means that this Notice does not limit in any way our use or disclosure of Aggregated Information and we reserve the right to use and disclose such Aggregated Information to our partners, advertisers and other third parties at our discretion.

WHOM WE SHARE YOUR INFORMATION WITH

We will share information collected in accordance with this Notice as follows:

Service Providers: We use service providers that may include, without limitation, employees of the business, consultants, partners, and vendors we use to carry out our services (“Service Providers).  We may share some of your personal information, including but not limited to booking information, appointment availability and related data with Service Providers.   Our Service Providers will be given access to your information as is reasonably necessary to provide the Services. 

 

Compliance with Laws:  We will not disclose your personal information to third parties except as set forth in this Notice and in the following circumstances: (i) to investigate and defend our members against any third party claims and/or allegations and/or otherwise to protect us from liability, (ii) to investigate, prevent and/or take action regarding suspected and/or actual illegal activities, (iii) to assist government enforcement agencies, respond to a legal process and/or comply with the law, (iv) to exercise or protect the rights, property and/or personal safety of the users of the Services and/or (v) to protect the security and/or integrity of the Service.

 

Business Transfer:  If we sell or otherwise transfer part or all of our business and/or assets to another organization (e.g., in the course of a transaction such as a merger, acquisition, bankruptcy, dissolution, liquidation, etc.), your information such as name and email address, user content and/or any other information collected through the Services may be among the items sold and/or transferred.

 

Authorized Parties:  We may share information about your use of the Services with your company or employer or other authorized third parties in order to provide information related to the curriculum, training, education, business training you received in relation to the Services.

MARKETING

You have the right at any time to prevent us from contacting you for marketing purposes.  When we send a promotional communication to a user, the user can opt out of further promotional communications by following the unsubscribe instructions provided in each promotional e-mail. You can also indicate that you do not wish to receive marketing communications from us by sending an email to privacy@whyofai.com.

YOUR RIGHTS AND YOUR INFORMATION

If applicable law allows, you may have certain rights over your Information.  This can include gaining access to the Information we hold, editing the Information for accuracy, asking us to delete it, etc.

Please contact us at privacy@whyofai.com if you have questions regarding any potential rights you may have.  We will work with you to fulfill your request if it is required by law in the time frame the law specifies.

SECURITY OF YOUR INFORMATION

We use third parties to execute our Services, but we also take precautions for any Information in our possession.  This includes having an accountable persons in our company responsible for the privacy and security of Information, maintaining unique usernames and passwords for any applications or systems we access, not sharing password information, maintaining physical security to keep non-authorized users out of our property, protecting the devices we have in our possession (mobile phones, laptops, etc.).

RETENTION OF INFORMATION

As we are committed to the privacy of your Information, we only hold on to Information for as long as we need it to provide Services to you.  We may retain limited Information to meet legal or compliance obligations our company must meet.

We utilize third party websites and vendors to help us execute our Services.  While we work with trusted partners who value your privacy, we encourage you to check their websites to learn more about their privacy practices.

PRIVACY OF CHILDREN

The Sites and the Service are not directed to anyone under the age of 13. The Sites do not knowingly collect or solicit information from anyone under the age of 13 or allow anyone under the age of 13 to sign up for the Service. If we learn that we have gathered personal information from anyone under the age of 13 without the consent of a parent or guardian, we will delete that information as soon as possible.
